Terms of Use
Last updated:
1. What myWishbook is
myWishbook is an app for sharing wishlists. You make a list of things you want, share it with a group of people, and they mark items as taken. You never find out who took what from your own list — that is the point of the app, and it is enforced in our database rather than merely hidden in the screens.
By creating an account or using the app, you agree to these Terms and to the Privacy Policy.
myWishbook is operated by Dallas Smith in Alberta, Canada. Contact: support@mywishbook.app.
2. You need an account
You sign up with an email address and a password. You must confirm the email address before you can sign in.
- Keep your password to yourself. You are responsible for what happens under your account.
- Give us a real email address. It is the only way we can reset your password or reach you, and we cannot recover an account whose email address you no longer control.
- One person, one account. Do not impersonate anyone else, and do not pick a handle or display name designed to look like someone else.
You must be at least 13 to create an account. myWishbook is not aimed at children. A Youth account, for a younger family member who keeps a list but cannot see anyone else's, must be created and supervised by their parent or guardian.
3. Acceptable use
Use the app for what it is for. Do not:
- Post anything unlawful, hateful, harassing, threatening, or sexually explicit.
- Upload images you do not have the right to use, or anyone's private information.
- Impersonate another person, or use someone else's account.
- Try to break, overload, or work around the app's security — in particular the rules that stop a list owner from learning who took their items, or that keep the Youth and External roles restricted.
- Scrape, resell or republish other people's lists or profiles.
- Use the app to send unwanted email by inviting addresses that did not ask to hear from you.
If you invite someone by email, you are saying you know that person and expect them to want the invitation.
4. Your content stays yours
Anything you put in the app — your lists, your items, your photos, your group names — belongs to you. We do not claim ownership of it.
You give us permission to store it, display it to the people you have shared it with, and process it as needed to run the app. That permission ends when you delete the content or your account, apart from the exceptions described in section 10 of the Privacy Policy.
You are responsible for what you upload, including having the right to upload it.
5. The free plan and its limits
The free plan is genuinely free and has no time limit. It allows:
- one active list at a time,
- membership of up to three groups in total,
- of which you may own one,
- and each of your lists may be shared into one group at a time.
There is no limit on how many items you can mark as taken in other people's lists.
7. Availability
We try to keep the app working, but we do not promise it will always be available. We may change features, and we may take it down for maintenance.
If we discontinue myWishbook, we will provide reasonable notice where practical and stop future subscription renewals where reasonably possible. We will allow existing paid Premium access to continue through the paid term where practical. Where continuation is not practical and a refund is required or appropriate, it will be handled through the applicable app-store process and applicable rules.
8. Ending your account
You can delete your account at any time in Profile → Delete my account. Section 10 of the Privacy Policy explains exactly what that erases — including that any group you own is deleted for everyone in it. Deleting your account does not cancel a subscription; cancel it through the applicable app-store subscription settings first.
We may suspend or remove an account that breaks these Terms, or that we reasonably believe is being used unlawfully or to harm someone else. Where it is practical and appropriate, we will tell you why first.
9. Disclaimers
The app is provided as is. We do not promise it will be uninterrupted, error-free, or that it will never lose data. Keep your own record of anything you cannot afford to lose.
We are not a shop. We do not sell, ship, verify or stand behind the items on your lists, the prices you type, or the shops you link to. Anything you buy, you buy from someone else.
We do not guarantee that another member will keep a surprise to themselves. The app makes it very hard for a list owner to learn who bought what, and we take that seriously — but we cannot stop a person from simply telling them.
10. Limits on our liability
To the extent permitted by applicable law, myWishbook and its operator are not liable for indirect, incidental, special or consequential losses arising from use of the service. To the extent permitted by law, total liability relating to the service will not exceed the amount the user paid for myWishbook during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
11. Changes to these Terms
We may update these Terms. If a change matters, we publish the new version and increase its version number; the app records which version you accepted when you signed up. If you keep using the app after a change, you are accepting it.
12. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there. Subject to any mandatory rights under applicable law, disputes relating to these Terms will be heard in the courts of Alberta.
Nothing in these Terms limits any mandatory consumer or other legal rights that cannot be excluded or waived under applicable law.
